Number Porting Supplement
This supplement contains additional terms and conditions pertaining to a telephone number assigned to Member under the Intellicomm Terms of Service, which are posted on the Innoport website at www.innoport.com ("Agreement"). Capitalized terms used but not otherwise defined herein shall have the meanings ascribed to them in the Agreement.

The telephone number(s) assigned to Member are either a North American telephone number ("North American Telephone Number" or "NATN") or a Non-North American telephone number ("Non-North American Telephone Number" or "NNATN").

A NATN is defined as a telephone number for the U.S. and its territories, Canada, and some Caribbean countries and has a ten-digit number format preceded with a country code of "1". For toll free numbers, only toll free numbers covering the U.S. and Canada are covered in the NATN definition.

A NNATN is defined as a telephone number which is not a North American Telephone Number.

In the event of a conflict between the Agreement and this supplement, this supplement will control.
North American Telephone Numbers Porting

PORT INS

To the extent Intellicomm supports and permits porting in of specific NATNs, a port in request may be made to Intellicomm by following the instructions provided upon request or available on the Innoport website and payment of any applicable fees.

Intellicomm or its vendor may be the customer of record for NATNs, whether ported in by Member or otherwise provided in connection with the Service. After port in, the NATN will only have the Services provided by Intellicomm, regardless of the services Member had on the NATN prior to port in. Intellicomm reserves the exclusive right to change its underlying carriers or vendors in connection with Member's use of the Service on the ported in NATN at any time.

Intellicomm does not provide any emergency calling, 911 or E-911 services as part of its Services.

PORT OUTS

Member may port out any NATN that Member uses for the Service so long as:
  • Member's account is current, active, and in good standing,
  • Member has informed Intellicomm in writing about its intent to port out the NATN prior to initiating the port out process with another party,
  • Member promptly informs Intellicomm upon completion of the port out so the NATN can be removed from Intellicomm's databases,
  • Member pays all charges in connection with the Service through the end of the term for the NATN, and
  • Member has paid to Intellicomm any applicable fees in connection with the port out.

Member that has not ported out a NATN prior to Member's termination, cancellation, or suspension of Service for any reason, or removal/deletion of a NATN from Member's account, is strictly prohibited from porting out such NATN.

In the event Member, either directly or indirectly, ports out a NATN in violation of this supplement, Member agrees to:
  • immediately return the NATN to Intellicomm at its sole cost and expense,
  • pay Intellicomm an amount equal to the lesser of $250 or the maximum allowed under applicable law, which shall be charged to Member's credit card on file,
  • take any and all measures, including payment of any additional fees, to return the NATN to Intellicomm immediately, and
  • indemnify Intellicomm against this violation, including any losses due to misdirected information resulting from this violation.

A port out of a NATN does not terminate Service and Member is responsible for following Intellicomm’s established cancellation procedures for cancelling Service.
Non-North American Telephone Numbers Porting
  • Member agrees to use the NNATN in compliance with the laws and regulations of the telecommunications regulatory authority of the country to which the NNATN belongs and subject to any restrictions applicable to such NNATNs.
  • Intellicomm may be asked to provide Member's name, address, telephone number(s), email address, any ID number (if applicable) and any other relevant information to its vendor and/or the telecommunications regulatory authority providing the NNATN at any time, and Member agrees to provide and keep current such information at all times.
  • Member that has an NNATN assigned in connection with Member's use of the Service may be entitled to port out such NNATN so long as:

    • Member's account is current, active, and in good standing,
    • Member has informed Intellicomm about its intent to port out the NNATN prior to initiating the port out process with another party,
    • Member promptly informs Intellicomm upon completion of the port out so the NNATN can be removed from Intellicomm's databases, and
    • Member has paid to Intellicomm a $35 administrative fee and any third party costs incurred by Intellicomm in connection with the port out, if permitted by applicable law.

  • Member that has not ported out an NNATN prior to Member's termination of Service or removal/deletion of an NNATN from Member's account is strictly prohibited from porting out such NNATN.
  • To the extent number portability is available in a particular country and Intellicomm supports and permits porting in of NNATNs, a port in request may be made to Intellicomm by following the instructions provided upon request or available on the Innoport website and payment of any applicable fees.
  • Intellicomm or a vendor may be the customer of record for NNATNs whether ported in or otherwise provided in connection with the Service.
  • Port in or port out of NNATNs may be subject to restrictions under a separate policy available on the Innoport website.
  • In the event Member ports out an NNATN in violation of this supplement, Member agrees to (a) immediately return the NNATN to Intellicomm, (b) pay Intellicomm an amount equal to $250 (or the maximum allowed under applicable law) charged to Member's credit card on file, and (c) take any and all measures, including payment of any additional fees, to return the NNATN to Intellicomm immediately.
  • Member agrees not to use any NNATN as a caller ID or caller line identification for any outgoing calls or transmissions (voice, fax, SMS, text messaging or otherwise), for emergency services (911, e911 and similar), or for location information for emergency services.
  • Member agrees not to use any NNATN to trigger callback services and collect calls.
  • Member agrees not to use any NNATN for calling card applications or services.
